Labor Compliance Services

RLS Compliance, LLC contract compliance services are geared to provide comprehensive support for our clients in compliance with their contract obligations.

Our labor compliance services include:

  • Develop a project specific  and streamlined labor compliance process that delivers the overall goal of subcontractor compliance.
  • Review awarding body’s internal labor compliance systems, processes, and procedures.
  • Compliance monitoring and audits of federal and state certified payroll reports to ensure timely submittal of certified payroll reports and other required submittals utilizing labor compliance software program and various manual review audit tools.
  • Validate the accuracy of subcontractor certified payroll reports.
  • Audit for proper trade classification when compared to work summaries, project journals, sign-In sheets, timesheets, and daily construction reports.
  • Audit subcontractor daily reports and certified payroll reports to ensure accurate payroll data input and worker payments.
  • Validate trade classifications accuracy.
  • Assist in the resolution of prevailing wage violations or potential violations discovered through compliance verification, worker complaints, project team audit requests, or owner discovered discrepancies.
  • Perform random and detailed audits.
  • Calculate back wages and potential penalties upon prevailing wage violations for underpayment occurrences discovered in internal audits.
  • Issue delinquency notices to subcontractors for violations and infractions and request corrective action.
  • Recommend withholding of contractor’s funds from progress payments for noncompliance.
  • Verify wages and prepare wage underpayment reports as required by awarding agency.
  • Work site monitoring, perform site visits and observations and conduct worker interviews to ensure accuracy of subcontractor reporting and invoicing.
  • Collect safe harbor affidavits upon progress and final payments.
  • Union apprenticeship / training provisions, ensure apprenticeship compliance, including but not limited to proper apprentice registration, apprentice requests, DAS142 submittals, and apprentice to journeyman ratios.
  • Verify payment of training fund payments and/or fringe benefit contributions.
  • Review labor compliance packet for pre-construction conferences and subcontractor orientation meetings to ensure compliance with state and federal labor code and contract requirements.
  • Participate in pre-bid and preconstruction conference and subcontractor orientation meetings.
  • Review subcontractor agreements for compliance with state and federal labor code compliance.
  • Worker complaint investigations.
  • Communicate compliance status (underpayment reports via monthly subcontractor status reporting)
  • Act as the project team labor compliance point of contact and liaison to the awarding body and all subcontractors on all labor compliance matters.
  • Attend meetings with awarding body labor compliance staff.
  • Resolve wage issues including audits performed by the awarding body labor compliance staff.
  • Conduct final review and close-out of all contractors at all tiers. Ensure files are organized and contain complete reporting and correspondence for record keeping purposes and potential audits conducted prior to statute of limitations. Ensure all certified payroll reports and required forms have been collected on-line. Ensure collection of safe harbor affidavits. Approve final authorization to release retention for primary subcontractors. Provide all working files including but not limited to certified payroll reports, email communication, correspondence letters, contract requirement research, audit documents, and other related documents.
